Terms and Conditions

These terms and conditions regulate both the Booking you ordered through Our Website and the occupation of your Room or other facility when you come to our House. When you use Our Website or book a Room, you confirm your agreement to these terms. We are Heaven’s Rest B&B and our address is 180 Mill Road, 2675 Bombay, Auckland, New Zealand.

Definitions

“Booking”means the booking of accommodation offered by us on Our Website.
“Us”, “Our” or “We”refers to Heaven’s Rest B&B.
“Our Website”means any website or service designed for electronic access by mobile or fixed devices which is owned or operated by us. It includes all the web pages controlled by us.
“Room”means any room (Kakapo Wing, Tui Wing, Kiwi Cabin, Kea Cabin) offered for Booking.
“House”means shared and common space of our bed and breakfast at the address given above.
“Services”means the provision by us of any accommodation and/or supply of food and drink and other services.

Interpretation

Any headings to paragraphs and schedules (if any) to this agreement are inserted for convenience only and do not affect the interpretation. Any agreement by either party not to do or omit to do something includes an obligation not to allow some other person to do or omit to do that same thing. This agreement is made only in the English language. If there is any conflict in meaning between the English language version of this agreement and any version or translation of this agreement in any other language, the English language version shall prevail.

Basis of Contract

  • In entering into this contract you have not relied on any representation or information from any source except the Booking details, the descriptions of the Rooms and explanation of the Services given on Our Website.
  • You acknowledge that you understand exactly what is included in the Services and you are satisfied that the Room and Services are suitable and satisfactory for your requirements.
  • The contract between us comes into existence only when we write to you to confirm that the Room you want is available. A contract is formed only when we confirm your booking in writing. If we decline to Book a Room we shall immediately return your money to your credit card.
  • We may change this agreement and / or the way we provide a Room, at any time. If you make any payment for Rooms or Services in the future, you will do so under the terms posted on Our Website at that time.
  • One or more notices in a Room you have booked or around the House may contain information or our requirements as to procedures and behaviour. By accepting this agreement, you are deemed to have accepted these notices as being incorporated in this contract.
  • If you book a Room in the name of a business or company, you confirm that you have full authority to do so and you accept personal liability for any breach of this contract by any person who comes onto our House.

Your booking

You may place a Booking either by completing the reservation form powered by our partner Beds24, by phone, email or through our contact form. A valid credit card is needed to secure your booking.

You cannot resell your Booking (in whole or in part). If you resell (or attempt to resell), Heaven’s Rest B&B will terminate your booking and retain any money paid to us for such Booking.

Transfers of a booking can only occur with prior written consent of Heaven’s Rest B&B. If you transfer (or attempt to transfer) without consent, Heaven’s Rest B&B will terminate your booking and retain any money paid to us for such Booking.

By making a Booking you agree not to use the Room or any facilities of our House for any commercial activity, event, or activity for profit without our prior written consent, in accordance with the “Commercial Use, Events, and Group Bookings” section of these terms.

We reserve the right to terminate your Booking and retain any money paid where you are in breach of these terms, including unauthorised commercial use or events, where reasonably justified.

You may make a Booking on someone else’s behalf. You are responsible for ensuring that any customer in your booking complies with these terms as if that customer had made the Booking. Where a booking includes multiple guests or a group, the person making the booking is responsible for ensuring all guests comply with these terms.

You can only make a Booking if you are 18 years old or over. If you arrive at the House and are under 18 years of age, you will not be permitted to stay alone.

We may require a passport or valid driver’s licence.

You must ensure that the name on a Booking is correct at the time of Booking. Except as otherwise stated in these terms, this cannot be changed after making the Booking.

We reserve the right to refuse any booking at our discretion.

Commercial Use, Events, and Group Bookings

Heaven’s Rest B&B is a quiet accommodation provider. Parties and unauthorised gatherings are strictly prohibited.

Any commercial activity, retreat, workshop, group event, or use of the property for business or profit purposes is only permitted with our prior written approval.

Where approved, additional fees, terms, and a separate agreement may apply.

The organiser of any approved event or group booking is responsible for:
– the conduct and behaviour of all attendees;
– compliance with all applicable laws, including health and safety obligations;
– ensuring appropriate insurance is in place where required.

We reserve the right to refuse, cancel, or immediately terminate any booking or event that has not been approved in advance or breaches these terms, without refund where reasonably justified.

Approval for any commercial use or event is granted at our sole discretion.

Security of your credit card

We take care to make Our Website safe for you to use. Card payments are not processed on a page controlled by us. All transactions are processed through the secure payment service provider Stripe. Your credit card details are not held by Heaven’s Rest B&B and cannot be accessed.

Payment and Price

  • All rates are per room per night. A continental breakfast or breakfast provisions are included in the Room price. Rates do not include other costs you may choose to incur during your stay (unless otherwise stated). Rates quoted are correct only for the specific number of guests, nights and dates shown. Should You change the number of guests, dates or nights, then the rates may be subject to change.
  • Payment is due on arrival, except for online Bookings made outside our FREE cancellation period, which require full payment at the time of the booking.
  • We accept payment by cash, credit/debit card (VISA, MasterCard, JBC, American Express, Union Pay) and PayPal. We do not accept any cheques.
  • Bank transfer is available upon request for guests with a New Zealand bank account and has to be arranged prior arrival.
  • Heaven’s Rest B&B collects credit card payments via its contracted partner STRIPE.

Cancellation, Modification and No-Show

At Heaven’s Rest B&B, we understand that travel plans can change. To ensure a seamless experience for our guests, we offer the following cancellation and modification terms:

  • A room reservation is guaranteed until 9:00 PM on the arrival date unless alternative arrangements have been confirmed with us in writing. Please notify us if you anticipate arriving after 9:00 PM to keep your room secured.
  • Cancellations and modifications are free of charge if made before the free cancellation period associated with your specific rate.
  • The free cancellation period may vary depending on the rate selected at the time of booking. For the exact free cancellation period, please refer to the ‘Cancellation Policy’ details under the rate description on our booking page.
  • Bookings cancelled or modified after the rate-specific free cancellation period will incur a charge equal to the full reservation price.
  • In the event of a no-show (the guest does not arrive on the scheduled date), the full reservation price will also be charged.
  • We will send you a confirmation of any cancellation or modification, which you should retain as proof of your request.


We recommend reviewing the rate details carefully when making a booking to be fully informed about the applicable cancellation terms. For any further assistance or to make special arrangements, please contact us directly.

Where bookings are made through third-party platforms, the cancellation policy of that platform may apply and may differ from our standard terms. In all cases, the applicable cancellation terms are those confirmed at the time of booking.

Arrival and departure

Our Rooms are available from 3.00 PM on the arrival date. Please let us know if you are likely to arrive after 9.00 PM, so we can arrange a self check in with you. Your Room must be vacated by 10.00 AM  on the day of departure. If you do not fully vacate by this time, we may charge you for an additional night.
Early check-ins and late check-outs are subject to availability and only upon request. Please contact us prior to your arrival. These conditions may change if the booking is made through a different provider.

Guest Responsibilities on Departure

Please leave our Rooms in a clean and tidy state in order to avoid additional cleaning charges. In the event that the accommodations require cleaning beyond the normal procedure due to the guest’s actions, an additional cleaning fee will be charged to the guest. The amount of the fee will be determined by the extent of cleaning required, and will be disclosed to the guest as soon as practicable. This fee is to cover the extra time and resources required to return the accommodations to their original condition, ensuring a pleasant and hygienic environment for all our guests.

Upon departure ensure the following:

  • Dishes clean and put away/ dishwasher turned on
  • Linen is to be left on the beds and used towels in the bathroom
  • The BBQ is cleaned
  • Please dispose of any rubbish in the bins provided
  • Make sure all devices, lights heaters and heat pumps are turned off
  • Leave keys on the kitchen bench
 

Rubbish: There are rubbish bins in each room as well as in the kitchen in our farmhouse. If you stay in one of our cabins, place your rubbish in the bins outside the cabins:

  • Yellow lid bin: Recycling – any bottles, newspapers, hard plastic and cans
  • Red lid bin: Any other general rubbish
  • You can leave compostable waste (food scraps) in a bowl for our compost

Children

Children of all age are welcome at Heaven’s Rest B&B, but must be under supervision at all times by parents or adult carers with particular emphasis on safety of themselves and others and respect for other guests privacy and belongings. Infants of 1 year and under stay with us free of charge.

Pets

We do allow pets for bookings in our Kea and Kiwi Cabin only. For more information please view our Pet Policy.

SPa Pool

We reserve the right to charge accordingly for excessive soiling of the spa pool water. Failure to adhere to these guidelines may result in guests being asked to exit the spa pool immediately.

Please note that the spa pool may be unavailable at times due to maintenance or other reasons; we encourage guests to reach out in advance to confirm its availability.

Required Actions for Spa Pool Use:

1. Read and Understand Rules: Prior to using the spa pool, please familiarize yourself with these guidelines.
2. Personal Hygiene: Shower thoroughly before and after spa pool use, making sure to rinse off oils, shampoos, and soaps completely.
3. Appropriate Attire: Wear suitable swimwear at all times.
4. Child Supervision: Children must be supervised by an adult at all times.
5. Hair Management: Keep long hair secured and away from drains.
6. Cover Closure: Ensure the spa pool cover is securely closed after use (assistance from another person is recommended).
7. Risk Acknowledgment: Use of the spa pool is at your own risk, except where any injury or loss is caused by our negligence.

Prohibited Actions in the Spa Pool:

1. Personal Cosmetics: The use of personal hygiene products such as razors, masks, and scrubs is not allowed.
2. Additional Substances: Avoid adding external products or substances to the water.
3. Food and Drinks: No food or beverages allowed.
4. Unsanitary Behavior: Spitting, urinating, or defecating in the spa pool is strictly prohibited.
5. Foreign Objects: Do not introduce any foreign liquids or dirty objects into the pool.
6. Smoking: Smoking is not permitted.
7. Glass Containers: Glass is strictly prohibited in the spa area.
8. Inappropriate Conduct: No jumping, climbing, or making excessive noise.
9. Spa Cover: Do not sit or lie on the spa pool cover.
10. Head Submersion: Avoid submerging your head under water.
11. Young Children: Children under 3 must wear water-appropriate diapers.
12. Health Restrictions: No entry if suffering from infectious or contagious diseases, or if you have open wounds.

VISITORS

Only registered guests are permitted on the property unless prior approval has been granted. Unauthorised visitors may result in additional charges or termination of the booking without refund.

Noise

Guests are expected to be considerate of others by keeping noise to a minimum generally and especially at night.  Televisions and music must be at acceptably lower levels after 9pm and before 8am.  Guests entering and leaving the property late night and early morning and using the common areas should do so quietly.

Restrictions

The name on the booking is responsible for any guests at the Room and their actions. It is requested that common courtesy is paid to the property, owners, other guests and neighbours. For yourself and every person who comes to Heaven’s Rest B&B, you agree that you will not:

  • smoke or vape in any of our Rooms or anywhere inside our house. If you do, we may terminate your stay immediately and you will not be entitled to compensation. Guest that wish to smoke/ vape can do so outside only and will be provided with ash trays. Guests must ensure that cigarettes/cigars are extinguished and disposed properly.
  • use our Rooms or property for parties or any other events without our permission.
  • bring any other people than stated in the Booking to our Rooms or our property. All visitor to Heaven’s Rest B&B must be pre-approved by us.
  • use in the Room any electrical appliance without obtaining our specific consent in advance.
  • transfer the Room reservation to any other person. If some person who is not obviously a member of your family or group tries to take up your reservation, we shall not allow him to do so.
  • cause damage or extensive soiling to any part of the Room, House or property. If you do, you agree to pay the reasonable cost of repair, replacement, or additional cleaning required as a result of such damage.
  • disturb other guests by keeping noise to a minimum generally and especially at night.  Televisions and music must be at acceptably lower levels after 9pm and before 8am.  Guests entering and leaving the property late night and early morning and using the common areas should do so quietly.

Safety, Health and Security

Guests must comply with all reasonable health and safety instructions during their stay.

Due to the rural nature of the property, hazards may include uneven ground, outdoor features, wildlife, and weather conditions. Guests are responsible for taking reasonable care for their own safety and that of others.

Children must be supervised at all times.

Guests must familiarise themselves with emergency procedures and ensure exits remain unobstructed.

We are not responsible for loss or damage to vehicles or personal belongings.

Availability and Relocation

In the rare case that due to unforeseen circumstances we cannot deliver Your requested accommodation, you will be offered alternate accommodation if possible or a full refund of any money paid by you.  Specific room types and bedding types for double/twin rooms cannot be guaranteed and are subject to availability at the time of check in. It is always guaranteed that the room provided by us will accommodate the number of guests booked.

Liability

Nothing in these terms limits or excludes any rights you have under the Consumer Guarantees Act 1993 or any other applicable New Zealand law.

To the maximum extent permitted by law:
– We are not responsible for any loss or damage to personal property brought onto the premises.
– Guests use all facilities, including outdoor areas and spa pool, at their own risk except where loss or injury is caused by our negligence.

Our total liability to you for any claim arising from your stay is limited to the total price paid for your booking, except where liability cannot be limited under New Zealand law.

We are not liable for any indirect, consequential, or economic loss.

EVENTS OUTSIDE OUR CONTROL

We are not liable for any failure or delay in providing accommodation or services where this is due to events beyond our reasonable control, including but not limited to:

– power outages
– water supply issues
– weather events
– natural disasters
– road closures or infrastructure failures

No compensation will be payable in such circumstances, although we will make reasonable efforts to assist where possible.

Your indemnity

You agree to be responsible for any loss or damage caused to Heaven’s Rest B&B, its property, staff, contractors, or other guests arising from:

– your breach of these terms;
– damage caused by you or any person in your booking group;
– your actions that negatively affect other guests or the operation of the property.

This clause does not limit any rights you have under New Zealand law.

ADDITIONAL SERVICES

Any additional services offered by Heaven’s Rest B&B (including transport, transfers, or special arrangements) are provided at our discretion and subject to availability.

We do not guarantee the availability, timing, or suitability of such services and accept no liability for delays or disruption outside our control.

Miscellaneous matters

  • Any obligation in this agreement intended to continue to have effect after termination or completion shall so continue.
  • No failure or delay by any party to exercise any right, power or remedy will operate as a waiver of it nor indicate any intention to reduce that or any other right in the future.
  • Any communication to be served on either party by the other shall be sent by  recorded delivery or by e-mail. It shall be deemed to have been delivered: If sent by recorded delivery to the correct address: within 72 hours of posting. If sent by e-mail to the address from which the receiving party has last sent e-mail: within 24 hours if no notice of non-receipt has been received by the sender
  • In the event of a dispute between the parties to this agreement, then they undertake to attempt to settle the dispute by engaging in good faith with the other in a process of mediation before commencing arbitration or litigation.
  • This agreement does not give any right to any third party.
  • The validity, construction and performance of this agreement shall be governed by the laws of New Zealand.

Changes

We may update these terms and conditions from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
